TUKAZZA CLUB has entered into a partnership with SUPERHOG , a company incorporated under English law, having its registered office at Unit 2 Nine Mile Water, Nether Wallop, STOCKBRIDGE, UNITED KINGDOM, SO20 8DR, registered under number 11871938 in the English Companies Register, whose website is www.superhog.com and whose General Terms and Conditions can be found here: https://superhog.com/terms-conditions/.
The purpose of this partnership is to enable Welcomer Members of the WELCOMECLUB Website to benefit from the "Host Guarantee" offered by SUPERHOG, which is also responsible, on behalf of TUKAZZA CLUB, for verifying WELCOMECLUB Website Members when they register on the Website.
- GENERAL INFORMATION
TUKAZZA CLUB has entered into a partnership with SUPERHOG in order to offer each Welcomer "Host Member" protection of their Property during Rental Agreements through the WELCOMECLUB Website under the conditions and within the limits described below.
This protection is provided by TUKAZZA CLUB in partnership with SUPERHOG and is subject to SUPERHOG's General Terms and Conditions for the "Host Guarantee" https://superhog.com/host-guarantee/, which each Member has acknowledged and agreed to respect.
Consequently, any use of the protection provided by TUKAZZA CLUB in partnership with SUPERHOG implies the full and unreserved acceptance by each Member of SUPERHOG's General Terms and Conditions relating to the "Host Guarantee" https://superhog.com/host-guarantee/ prior to any Reservation on the WELCOMECLUB Website.
TUKAZZA CLUB specifies that the purpose of this page is to present this protection offered by TUKAZZA CLUB to its Members and provided by the SUPERHOG Company.
This page has been set up for the sole purpose of providing information to members of the WELCOMECLUB Website.
TUKAZZA CLUB reminds you that the General Terms and Conditions of the SUPERHOG Company relating to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ as well as all other General and Special Terms and Conditions of the SUPERHOG Company available on its Website www.superhog.com constitute the contractual basis of the protection of the Welcomer's Property offered by TUKAZZA CLUB to its Members.
Consequently, TUKAZZA CLUB invites Members to regularly consult the General Terms and Conditions of the SUPERHOG Company relating to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/, applicable to the protection offered, which are likely to change frequently.
THE PROTECTION OFFERED BY TUKAZZA CLUB IN PARTNERSHIP WITH SUPERHOG DOES NOT CONSTITUTE AN INSURANCE PRODUCT AND/OR AN INSURANCE SERVICE AND/OR AN INSURANCE POLICY.
IT IS NOT INTENDED TO REPLACE THE CIVIL LIABILITY AND COMPREHENSIVE HOME INSURANCE POLICIES AND CONTRACTS THAT MEMBERS ARE REQUIRED TO TAKE OUT AS PART OF THEIR WELCOMECLUB WEBSITE MEMBERSHIP.
- PURPOSE OF WELCOMER PROPERTY PROTECTION
Thanks to the partnership between TUKAZZA CLUB and SUPERHOG, all approved Reservations (for which Members have successfully completed the verification process with our partner SUPERHOG) include protection against damage to the Welcomer "Host Member"'s Property, caused by another Member during a Rental.
This protection is offered on a commercial basis by TUKAZZA CLUB to its Members and is subject to the General Terms and Conditions of SUPERHOG relating to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/
This protection provided to each Welcomer "Host Member" by TUKAZZA CLUB in partnership with SUPERHOG, and at its sole discretion, guarantees to each Welcomer "Host Member" that the Members will assume the damage caused to its Property during a Rental for which they are responsible.
Failing this, TUKAZZA CLUB in partnership with SUPERHOG may, at its sole discretion and within the conditions and limits set forth in the "Host Guarantee" https://superhog.com/superhog-host-guarantee/, compensate the Welcomer "Host Member".
In the event of compensation under the conditions and limits set forth in the "Host Guarantee" https://superhog.com/superhog-host-guarantee/, SUPERHOG will be subrogated to the rights of the Welcomer "Host Member" to recover the amount paid from the perpetrator(s).
No compensation paid under the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ shall constitute a waiver, reduction, or cancellation of a Member's liability for any damage caused by that Member or any other person for whom that Member is responsible.
Notwithstanding the protection offered by TUKAZZA CLUB in partnership with SUPERHOG, the Welcomer "Host Member" remains responsible for taking out a multi-risk home insurance policy to cover the risks associated with making his Property available to any third party, including all damage and losses caused to the Property and its equipment by any third party, and remains responsible for taking reasonable measures to secure his Property during Rental Agreements (such as periodically changing the Property's locks or access codes).
The protection offered by TUKAZZA CLUB in partnership with SUPERHOG is subject to change and evolution. TUKAZZA CLUB therefore invites each Member to regularly consult the General Terms and Conditions of SUPERHOG relating to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ as well as all other General and Special Terms and Conditions of SUPERHOG available on its Website www.superhog.com.
- CONDITIONS AND LIMITS OF PROTECTION
The protection offered by TUKAZZA CLUB in partnership with SUPERHOG covers damage caused to the Welcomer's Property by another Member or any person present in the Property during the Rental Agreement.
Damage to the Property means damage to any permanent building, including installations and accessories, or to the contents of the Welcomer "Host Member"'s Property, caused by the actions or inactions, whether accidental, deliberate, or malicious, of another Member or of any person present in the Property at the time of the Rental Agreement.
Damage to Property includes damage caused by theft or attempted theft, made possible by the actions or inactions of a Member or any person present in the Property during the Rental Agreement.
The maximum amount that may be allocated to the Welcomer "Host Member", at the sole discretion of TUKAZZA CLUB and SUPERHOG, is equal to the lower of the insured values for the Property that has suffered injury and/or damage during the Rental Agreement and the sum of 5,000,000 USD (five million US dollars).
In the context of any compensation under the protection offered by TUKAZZA CLUB in partnership with SUPERHOG, the maximum amount that may be awarded to the Welcomer "Host Member", at the sole discretion of TUKAZZA CLUB and SUPERHOG, for harm and/or damage to the contents of the Welcomer "Host Member"'s Property is 150,000 USD (one hundred and fifty thousand US dollars).
The protection offered by TUKAZZA CLUB in partnership with SUPERHOG is subject to compliance with the following cumulative conditions:
The Property to be protected must have been the subject of an approved Reservation (i.e. for which Members have successfully completed the verification process with SUPERHOG);
The Welcomer "Host Member" must take all reasonable measures to reduce the costs of any material damage and agree to provide all necessary assistance to TUKAZZA CLUB and SUPERHOG and/or its partners in order to assess the material damage and to pursue liability against the Member responsible for the damage;
The Welcomer "Host Member" acknowledges and agrees to be bound by the General Terms and Conditions of SUPERHOG pertaining to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ as well as by all other General and Special Terms and Conditions of SUPERHOG, available on its website www.superhog.com, and published at the time of the occurrence of the material damage.
If one of these conditions is not met, the application for protection may be refused or reduced, at the sole discretion of TUKAZZA CLUB and SUPERHOG.
Compensation paid under the protection offered by TUKAZZA CLUB in partnership with SUPERHOG shall not release, reduce, or eliminate a Member's liability for property damage.
Any compensation paid under the protection offered by TUKAZZA CLUB in partnership with SUPERHOG transfers the liability of the infringing Member so that it becomes a liability to SUPERHOG rather than to the Welcomer "Host Member".
The conditions and limits of the protection offered by TUKAZZA CLUB in partnership with SUPERHOG are subject to change and evolution. TUKAZZA CLUB therefore invites each Member to regularly consult the General Conditions of SUPERHOG pertaining to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ as well as all other General and Special Conditions of SUPERHOG, available on its Website www.superhog.com.
- PROTECTION EXCLUSIONS
TUKAZZA CLUB in partnership with SUPERHOG will not pay any compensation for the protection of the Welcomer "Host Member"'s Property for:
- property damage that cannot be proven to have been caused by a Member during a Rental Agreement;
- the first 500 USD (five hundred U.S. dollars) of the cost of repairing any damage to property, as it is part of the deductible;
- cosmetic damage or wear and tear;
- accidental material damage resulting from a party held with the consent of the Welcomer "Host Member";
- material damage that the Welcomer "Host Member" could reasonably have expected or could have foreseen;
- bodily injury or other losses suffered by a Welcomer "Host Member" or a Homecomer "Guest Member" ;
- the cost of alternative accommodation for the Homecomer "Guest Member", the Welcomer "Host Member" or any other occupant;
- any loss of use of the Property or any consequential loss of income for the Homecomer "Guest Member", the Welcomer "Host Member", or any other occupant;
- material damage caused by a pet that the Welcomer "Host Member" has authorized to stay in the Property.
It is specified that, with regard to point b) above, the amount of the applicable excess is £500 (five hundred pounds sterling) or €500 (five hundred euros) depending on the location of the Property, or an amount equivalent to £ 500 (five hundred pounds sterling) in local currency if the Property is located outside a USD, GBP, or Euro currency zone.
The exclusions of the protection offered by TUKAZZA CLUB in partnership with SUPERHOG are subject to change and evolution. Consequently, TUKAZZA CLUB invites each Member to regularly consult the General Terms and Conditions of SUPERHOG pertaining to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/, as well as all other General and Special Terms and Conditions of SUPERHOG, available on its Website www.superhog.com.
- TERMS AND CONDITIONS FOR COMPENSATION CLAIMS
Any request for compensation by a Welcomer "Host Member", under the protection offered by TUKAZZA CLUB in partnership with SUPERHOG, must imperatively take place within 5 (five) days following the end of the Rental Agreement to TUKAZZA CLUB at the following address : sos@welcomeclub.com
The Welcomer "Host Member" is required to declare any damage to the Property to TUKAZZA CLUB within 5 (five) days following the end of the Rental Agreement and to provide all supporting documents, including, in particular:
- time-stamped photographs immediately before and after the Rental Agreement showing the damage to property;
- original invoices;
- quotes or estimates for replacement and/or repair;
- a valid home insurance policy for the property.
In certain circumstances, TUKAZZA CLUB, in partnership with SUPERHOG, may ask the Welcomer "Host Member" to apply to his or her insurance company for coverage before any protection is provided.
TUKAZZA CLUB and SUPERHOG reserve the right, at their sole discretion, to pay all or part of the compensation provided for under the protection of a Member's liability for damage caused to the Property of the Welcomer "Host Member".
To quantify the Member's liability, TUKAZZA CLUB in partnership with SUPERHOG may take into account factors such as, but not limited to:
- the cost of rebuilding or repairing the damaged Property to a condition equal to, but no better or greater than, that in which it was found at the beginning of the Rental Agreement;
- depreciation based on the expected life of the item, which has suffered material damage, in a rental environment;
- any contribution made to the damage by the Member or a third party, including the sale of any object that has suffered material damage and any waiver of the damage or any relevant security deposit.
TUKAZZA CLUB in partnership with SUPERHOG reserves the right to charge the Welcomer "Host Member" a contribution of 70 USD (seventy US dollars) for the costs associated with the implementation of the protection.
Any compensation paid under the protection offered by TUKAZZA CLUB in partnership with SUPERHOG will take this contribution into account.
TUKAZZA CLUB in partnership with SUPERHOG also reserves the right to take possession of any item for which compensation has been paid under the protection in order to replace it and the Welcomer "Host Member" agrees to provide reasonable assistance in such circumstances.
Any compensation paid under the protection will be made by bank transfer to the bank account provided by the Welcomer "Host Member" within 5 (five) days of the compensation agreement.
Compensation paid under the protection will be made in the appropriate local currency as converted on www.oanda.com at the time of payment.
The terms and conditions of claims under the protection offered by TUKAZZA CLUB in partnership with SUPERHOG are subject to change and evolution. Consequently, TUKAZZA CLUB invites each Member to regularly consult the General Terms and Conditions of SUPERHOG pertaining to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ as well as all other General and Special Terms and Conditions of SUPERHOG, available on its Website www.superhog.com.
- TERRITORY OF PROTECTION
The protection offered by TUKAZZA CLUB in partnership with SUPERHOG covers any property located anywhere in the world, with the exception of countries determined by the UK Foreign and Commonwealth Office to be unsuitable for travel on the day the Rental Agreement commences.
TUKAZZA CLUB, in partnership with SUPERHOG, will not be liable to pay any compensation for protection if such compensation:
(a) violates economic, financial, or trade sanctions imposed by the legislation of the country in which the protection would be implemented; or
(b) violates economic, financial, or trade sanctions imposed by Canada, the European Union, the United Kingdom, or the United States of America.
The territory applicable to the protection offered by TUKAZZA CLUB in partnership with SUPERHOG is subject to change and evolution. Consequently, TUKAZZA CLUB invites each Member to regularly consult the General Terms and Conditions of SUPERHOG pertaining to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ as well as all other General and Special Terms and Conditions of SUPERHOG, available on its Website www.superhog.com.
- APPLICABLE LAW
The protection offered by TUKAZZA CLUB in partnership with SUPERHOG is governed by the laws applicable to SUPERHOG, namely the laws of England and Wales.
Each Member agrees that any possible legal proceedings with SUPERHOG in relation to the said protection may only take place before the Courts of England and Wales.
The protection offered by TUKAZZA CLUB in partnership with SUPERHOG is subject to change and evolution. TUKAZZA CLUB therefore invites each Member to regularly consult the General Terms and Conditions of SUPERHOG relating to the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ as well as all other General and Special Terms and Conditions of SUPERHOG, available on its Website www.superhog.com.
- MISCELLANEOUS
TUKAZZA CLUB specifies that this page has been drawn up for the sole purpose of providing information and guidance to Members of the WELCOMECLUB Website.
TUKAZZA CLUB reminds you that the protection it offers in partnership with SUPERHOG is subject to SUPERHOG's General Terms and Conditions for the "Host Guarantee" https://superhog.com/superhog-host-guarantee/ and to all other General and Special Terms and Conditions of SUPERHOG, available on its Website www.superhog.com, applicable to said protection.
TUKAZZA CLUB shall not be held liable if SUPERHOG refuses to implement the protection, if SUPERHOG refuses to pay compensation, or if SUPERHOG fails to do so.
TUKAZZA CLUB is only involved in the transmission of information and documents between the Members of the WELCOMECLUB Website and SUPERHOG, and shall not be held liable for any reason whatsoever in the event that SUPERHOG refuses to pay compensation for the protection.
TUKAZZA CLUB offers this protection to its Members free of charge in order to assure its Members of the seriousness and quality of the WELCOMECLUB Website's matchmaking service.
TUKAZZA CLUB does not receive any remuneration of any kind from its Members and/or from its partner, SUPERHOG.
TUKAZZA CLUB specifies that the protection offered in no way constitutes an insurance product or policy and that neither TUKAZZA CLUB nor SUPERHOG are insurance companies, insurance agents, brokers, or any other insurance intermediary.
This protection is in no way intended to replace the insurance policies and contracts that Members are required to take out as part of their Membership to the WELCOMECLUB Website.
